The SCA has ruled in favour of a widow who wrote her late husband’s will in her own handwriting, the veracity of which was then challenged by her stepdaughters. According to a report in Die Burger, popular singer Nedine Blom and her sister appealed against a judgment in favour of Gerda Brown in the North Gauteng High Court, which had held Brown did not act unlawfully, but granted Blom and her sister leave to appeal. The High Court and SCA held that it was not fraudulent for the stepmother to have drafted the will herself, as she had done so on the instruction of her late husband. She did not try to influence him on his death bed, the judges held. Her husband died four days after she wrote the new will in front of witnesses.
